Terms and Conditions for Membership in the Cerebrovascular Disease Clinical-Image Convergence Database

Agreement to Terms of Service for the Clinical-Image Convergence Data Warehouse

Chapter 1: General Provisions
Article 1 (Purpose)
The purpose of these terms and conditions is to define the rights, obligations, and responsibilities of users and MDAISS in using the services provided by the Cerebrovascular Disease Clinical-Image Convergence Data Warehouse, as well as other necessary matters.
Article 2 (Effectiveness and Changes of Terms and Conditions)
    1. These terms and conditions shall be effective for all users who wish to use the service.
    2. The contents of these terms and conditions become effective when notified to users through some service screens or other methods.
    3. MDAISS may change the contents of these terms and conditions if deemed necessary, and the changed terms and conditions will be notified to users through the method mentioned in Clause 2.
    4. Users can discontinue the service and cancel their membership registration if they do not agree with the changed terms and conditions. If they continue to use the service, they are deemed to have agreed to the changed terms and conditions, which become effective in the same way as described above.
    5. If a user agrees to the contents of these terms and conditions, these terms and conditions shall take precedence over other laws regarding the user's use of the service provided by MDAISS. Matters not specified in these terms and conditions are subject to the relevant laws of the Republic of Korea and the regulations separately set by MDAISS.
Article 3 (Definitions of Terms)
    1. Definitions of terms used in these terms and conditions are as follows:
        ① User: A member or non-member who accesses the service and receives services provided by MDAISS.
        ② Member: An individual or corporation that has completed the membership registration process by agreeing to these terms and conditions and can use the services provided by the Cerebrovascular Disease Clinical-Image Convergence Data Warehouse.
        ③ Non-member: A person who uses the services provided by MDAISS without registering as a member.
        ④ ID (unique number): A combination of specific English letters and numbers selected by the user and approved by MDAISS for member identification and service use.
        ⑤ Password: A combination of letters, numbers, and special symbols set by the user for protecting member information.
        ⑥ Service termination: A declaration by MDAISS or a member to terminate the service use after using the service.
    2. The definitions of terms used in these terms and conditions, except for those defined in Clause 1, are as prescribed in the relevant laws and service-specific guides.
Chapter 2: Service Use Agreement
Article 4 (Formation of Use Agreement)
The use agreement is formed by the user's agreement to the contents of these terms and conditions and MDAISS's acceptance of the user's application.
Article 5 (Application for Use)
The application for use is made by the user recording personal information on the membership information screen required by MDAISS.
Article 6 (Acceptance and Rejection of Application for Use)
    1. MDAISS shall accept the service use application unless there are special circumstances if the user accurately fills out the matters specified in Article 5.
    2. MDAISS may limit the use of some services until the reasons for restrictions are resolved if:
        ① The contents are found to be false or there are reasonable grounds to suspect that they are false.
        ② Other cases deemed necessary by MDAISS.
    3. MDAISS may restrict the use application if:
        ① The application is made using another person's name.
        ② The contents of the application form are falsely stated.
        ③ The application is made for the purpose of disrupting public order or morals.
Article 7 (Changes to Contract Matters)
Members can view and modify their information at any time through member information management. Members must update their information if there are changes in the matters recorded at the time of application, and members are responsible for problems arising from not updating.
Chapter 3: Service Provision and Use
Article 8 (Use of Service)
    1. MDAISS shall commence the service from the time of accepting the member's use application. However, some services may be commenced for members above a specified grade.
    2. If MDAISS is unable to commence the service due to business or technical difficulties, it shall notify the site or the member.
    3. The use of the service is based on 24 hours a day, 365 days a year. However, the service may be temporarily suspended due to business or technical reasons, and MDAISS shall notify users of this beforehand or afterwards.
    4. Even after registering as a member, some services may be provided only to specific members at the service provider's request.
Article 9 (Service Changes, Suspension, and Storage and Use of Information)
    1. Members agree that MDAISS is not responsible for the loss of communication data such as messages stored or transmitted through the service in the event of a national emergency, power outage, or other force majeure events.
    2. If MDAISS has to temporarily suspend the service due to difficulties in providing normal services, it may notify members and suspend the service after one week. If there are significant reasons, the notice period may be reduced or omitted.
    3. If MDAISS has to permanently discontinue the service, it shall notify members one month in advance.
    4. MDAISS may temporarily modify, change, or discontinue the service after prior notice, and it shall not be responsible for any consequences to members or third parties.
    5. If a member violates the contents of these terms and conditions, MDAISS may suspend the member's service use without notice.
Article 10 (Provision of Information and Posting of Advertisements)
    1. MDAISS may provide various information and promotional materials to members via email, SMS, or other methods deemed necessary during service use.
    2. MDAISS may post advertisements on the service screen, homepage, email, etc., related to the operation of the service, and users are deemed to have agreed to this.
    3. MDAISS is not responsible for any loss or damage resulting from members' participation, communication, or transactions in promotional activities conducted by advertisers on the service.
Article 11 (Deletion of Posts or Contents)
    1. MDAISS may delete any content posted or registered by members in the service without prior notice if it is deemed to fall under any of the following categories:
        ① Content that defames or slanders MDAISS, other members, or third parties.
        ② Content that violates public order or morals.
        ③ Content related to criminal activities.
        ④ Content that infringes on third-party copyrights or other rights.
        ⑤ Content that does not fit the nature of the service.
        ⑥ Other content that violates related laws or MDAISS's regulations.
    2. MDAISS reserves the right to edit, move, or delete any content without prior notice if it violates these terms and conditions or if it is commercial or illegal.
    3. If the content posted exceeds a certain period and loses its effectiveness as a post, MDAISS may delete the post after a one-week notice period.
Article 12 (Copyright of Posts)
    1. The rights and responsibilities for all materials posted on the service lie with the poster, and MDAISS holds the right to display them on the service. MDAISS cannot use the posts for commercial purposes without the consent of the poster. However, this does not apply to non-commercial uses.
    2. Members are solely responsible for any civil or criminal liability arising from their posts infringing on the copyrights, software copyrights, or other rights of third parties.
    3. Members cannot commercially use the materials posted on the service, such as processing or selling the information obtained from the service.
Article 13 (Ownership of MDAISS)
    1. Intellectual property rights and other related rights for the services provided by MDAISS, including the necessary software, images, marks, logos, designs, service names, information, and trademarks, are owned by MDAISS.
    2. Except as explicitly approved by MDAISS, members may not modify, rent, loan, sell, distribute, create derivative works from, transfer, re-license, establish a security interest in, or commercially exploit any of the properties mentioned in the preceding paragraph, either in whole or in part. Members are also prohibited from allowing third parties to perform such acts.
Chapter 4: Obligations of the Contracting Parties
Article 14 (Member's Obligations and Information Security)
    1. Members must provide accurate and complete information ("registration information") when registering to use the service. If there are any changes to the registration information, members must promptly update their information.
    2. Upon completing the registration process, members will receive an ID and password. For the management of the ID and password:
        ① Members must promptly notify MDAISS if they become aware of any unauthorized use of their ID or password.
        ② Members must ensure that they log out from their account at the end of each session.
    3. While using the service, members must not:
        ① Use another person's personal information or allow a third party to use their personal information.
        ② Use the information obtained from the service for personal use, such as copying, processing, translating, creating derivative works, reproducing, performing, broadcasting, exhibiting, distributing, or publishing without authorization, or provide such information to third parties.
        ③ Damage the reputation of others or cause them disadvantages.
        ④ Infringe on MDAISS's or third parties' copyrights or other rights.
        ⑤ Distribute information, sentences, figures, videos, or sounds that violate public order or morals.
        ⑥ Engage in activities that are objectively recognized as related to crime.
        ⑦ Register or distribute data infected with computer viruses that may cause malfunctions or data destruction and confusion in service-related facilities.
        ⑧ Transmit information that may interfere with the stable operation of the service or send advertising information against the recipient's will.
        ⑨ Act in response to correction requests from authorized institutions such as the Information and Communication Ethics Committee or consumer protection organizations.
        ⑩ Violate election laws as determined by the Election Commission's cease-and-desist orders or warnings.
        ⑪ Engage in any activities that violate relevant laws.
Article 15 (Obligations of MDAISS)
    1. MDAISS must not engage in any activities prohibited by law or these terms and must strive to provide continuous and stable services.
    2. If the opinions or complaints raised by members are deemed justified, MDAISS must promptly address them.
    3. MDAISS must protect the personal information of members, including registration information, as stipulated by relevant laws. The protection of members' personal information is governed by the relevant laws and Article 16 of these terms.
Article 16 (Privacy Policy)
    1. MDAISS collects member information through the information provided during the application process and uses this information to fulfill this use contract and provide the services outlined in this contract.
    2. MDAISS must not disclose or distribute members' information obtained in connection with the provision of services to third parties without the members' consent, nor can it use the information for commercial purposes. However, this does not apply to cases where disclosure is required by law through legal procedures.
Chapter 5: Termination of the Contract
Article 17 (Termination of Contract and Restriction on Use)
    1. When a member wishes to terminate the use contract, they must apply for termination directly through the website.
    2. MDAISS may request or change a member's ID and password for reasons such as security policies and smooth service provision.
    3. MDAISS may terminate the use contract without prior notice or suspend service use and report to relevant authorities if the member engages in the following actions:
        ① Uses another person's personal information, service ID, or password.
        ② Intentionally interferes with the operation of the service.
        ③ Registers under a false name.
        ④ Registers multiple IDs under the same user.
        ⑤ Intentionally distributes content that harms public order or morals.
        ⑥ Plans or executes the use of the service to harm national interest or public welfare.
        ⑦ Slanders or damages the reputation of others or causes them disadvantages.
        ⑧ Sends information that interferes with the stable operation of the service or transmits advertising information against the recipient's will.
        ⑨ Distributes computer virus programs that cause malfunctions or data destruction.
        ⑩ Infringes on MDAISS's or third parties' intellectual property rights.
        ⑪ Receives correction requests from external institutions such as the Information and Communication Ethics Committee or the Election Commission for violating election laws.
        ⑫ Reproduces, distributes, or commercially uses information obtained from the service without MDAISS's prior consent.
        ⑬ Posts obscene content or links to obscene sites on bulletin boards.
        ⑭ Provides or updates inaccurate information.
        ⑮ Violates relevant laws, these terms, and other conditions set by MDAISS.
    4. MDAISS may delete the information of inactive members to manage members adequately and protect information. In such cases, it must notify the members via service notice or email.
Chapter 6: Miscellaneous
Article 18 (Fees and Paid Information)
The use of the service is basically free. However, this does not apply to paid information and services that are separately specified as such by the service.
Article 19 (Prohibition of Transfer)
Members cannot transfer, gift, or use as collateral their right to use the service or their position under the use contract.
Chapter 7: Compensation for Damages, etc.
Article 20 (Compensation for Damages)
MDAISS is not responsible for any damages incurred by users related to the use of the service unless the damage was caused by a criminal act intentionally committed by MDAISS.
Article 21 (Disclaimer)
    1. MDAISS is not responsible for service provision being impossible due to force majeure events such as natural disasters.
    2. MDAISS is not responsible for service use issues caused by users' faults.
    3. MDAISS is not responsible for the loss of expected profits or any damage arising from materials obtained through the service.
    4. MDAISS is not responsible for the reliability and accuracy of information, materials, or facts posted by users on the service.
Article 22 (Jurisdiction)
    1. MDAISS and members must make every effort to resolve disputes arising from service use amicably.
    2. If a lawsuit arises despite the efforts in the preceding paragraph, the court that has jurisdiction over MDAISS's location will be the competent court.
Addendum
These terms and conditions will be effective from June 20, 2024.

Consent to Collection and Use of Personal Information

The Cerebrovascular Disease Clinical-Image Convergence Data Warehouse collects the minimum amount of personal information necessary for member management and quality service provision with the consent of the data subject. The collected personal information is not used for purposes other than the collection and use purposes mentioned below. If you do not agree to the terms of service and the collection and use of personal information, membership registration will not be possible.
